Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nourata (the “Service”), a clinical decision-support and practice-management platform for nutrition professionals. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Professional Use

The Service is intended solely for use by qualified nutrition and health professionals in the course of their practice. By using the Service you represent that you are a licensed or otherwise duly qualified professional (or acting under the supervision of one), that you are at least 18 years old, and that you are authorized to enter into these Terms.

The Service is a professional tool. It is not intended for use by patients or members of the public, and it does not establish any relationship between Nourata and your patients.

2. The Service

Nourata provides tools to manage patient records, track laboratory results, build dietary and supplement plans, and generate AI-assisted recommendations (the “Kano” analysis engine). Features may change, be added, or be removed over time.

3. Not Medical Advice — Your Professional Responsibility

Nourata is a decision-support tool. It does not practice medicine, dietetics, or nutrition, and it does not provide medical advice, diagnosis, or treatment.

All outputs of the Service — including AI-generated supplement recommendations, biomarker interpretations, and dietary plans — are informational aids only. You are the qualified professional. You are solely responsible for exercising your own independent clinical judgment, for verifying all information before relying on it, and for every decision and recommendation you make for your patients. You must not rely on the Service as a substitute for your professional expertise, applicable clinical guidelines, or the standard of care.

AI-generated content may be inaccurate, incomplete, or out of date. Always review it critically and confirm against authoritative sources before acting on it.

4. Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must use a strong, unique password, keep it secret, and notify us promptly of any unauthorized access. You may not share your account or allow others to use it.

5. Subscriptions, Billing & Cancellation

Trial

New accounts may include a free trial period. At the end of the trial, continued access requires a paid subscription.

Recurring billing

Paid subscriptions are billed in advance on a recurring basis (e.g. monthly) at the price shown at checkout, through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on each renewal until you cancel.

Cancellation

You may cancel at any time from the billing portal (Settings → Billing). Your subscription remains active until the end of the current paid period, after which it will not renew. Cancellation stops future charges; it does not retroactively refund the current period.

Refunds & price changes

Except where required by law, payments are non-refundable, including for partial billing periods or unused time. We may change subscription prices on reasonable advance notice; changes apply to billing periods beginning after the notice.

Failed payments

If a payment fails, we may suspend or downgrade your access until payment is resolved.

6. Patient Data & Privacy

You may input personal and health information about your patients. As between you and Nourata, you are responsible for that information: for having a lawful basis and any necessary consents to collect and process it, for its accuracy, and for complying with all laws applicable to your practice (including privacy and health- information laws such as PIPEDA and, where applicable, HIPAA).

Our handling of personal information is described in our Privacy Policy and Cookie Policy. You are responsible for ensuring your use of the Service with patient data is permitted under your professional and legal obligations.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulation applicable to your practice;
  • Upload content you have no right to use, or that is malicious, infringing, or harmful;
  • Attempt to access accounts, data, or systems that are not yours;
  • Reverse engineer, scrape, overload, or interfere with the Service;
  • Resell or provide the Service to third parties except your own patients in the ordinary course of your practice.

8. Intellectual Property

The Service, including its software, design, and content (excluding your data), is owned by Nourata and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your practice during your subscription. You retain ownership of the patient and practice data you input; you grant us the limited rights needed to host and process it to provide the Service.

9. Third-Party Services

The Service relies on third parties — including Stripe (payments), Supabase (hosting/database), and AI providers used by the Kano engine — to function. Your use may be subject to their terms, and we are not responsible for their acts or omissions. Availability of the Service may depend on these providers.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output is accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by law, Nourata and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or patient outcomes, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Nourata from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your data, your professional advice and decisions, or your breach of these Terms or of any law applicable to your practice.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. ownership, disclaimers, limitation of liability, indemnification) will survive. You may request export or deletion of your data as described in our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or in-app notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the federal laws of Canada and the laws of the Canadian province or territory in which the operator of the Service is located, without regard to conflict-of-laws principles. You agree to the jurisdiction of the courts of Canada for any dispute arising out of or relating to these Terms or the Service, except where applicable law provides otherwise.
